Additional TrainingWe provide approximately 2 weeks of initial training for you and one additional person, included in the Franchise Fee. You pay for additional training if you request it, currently $300 per day plus expenses. We may require you to pay costs for a replacement Designated Manager's training if manager changes are excessive or due to poor hiring practices. Ongoing training programs are provided from time to time, with no tuition or training fees, but you are responsible for travel, lodging, and food expenses. Attendance will not be required more than 2 times per year and collectively will not exceed 2 days in any year.

DescriptionYou will be granted a Protected Territory consisting of a geographic area or radius containing a minimum population of approximately three hundred fifty thousand (350,000) people, as determined by reference to the most recent U.S. Census Bureau figures. The size will vary based on factors like population, drive time, natural boundaries, demographics, and traffic counts. The boundaries will be defined by streets, zip codes, or other appropriate boundaries and specified in the Franchise Agreement or an Exhibit. If you are in compliance with the Franchise Agreement, we will not establish or license other MONSTER MINI GOLF Businesses or competing businesses within your Protected Territory. We reserve the right to operate other businesses or channels of distribution outside your Protected Territory.

Renewal ConditionsTo renew, you must have substantially complied with the Franchise Agreement, have the right to possess the Approved Location, made necessary capital expenditures, satisfied all monetary obligations, not be in default, given timely written notice of intent to renew, sign a current Franchise Agreement (terms may differ materially, but Protected Territory remains the same), comply with current qualifications and training, and sign a general release.

Transfer ConditionsYou may not transfer your interest without our prior written consent, which will not be unreasonably withheld. Conditions include: compliance with Section 19, all obligations paid, refurbishment of the business to current standards, execution of a general release by transferring owners, prospective transferee meeting our business and financial standards, transferee executing the then-current Franchise Agreement, transferee executing a general release, providing copies of all transfer contracts, payment of a $7,500 transfer fee, transferee (or 20%+ owners) agreeing to be personally bound, franchisee remaining liable for prior obligations, transferee obtaining all necessary third-party consents, and transferee's Designated Manager completing initial training.
Termination for CauseWe have the right to terminate without opportunity to cure if you fail to establish/equip the business, fail to complete training, make material misrepresentation, are convicted of a felony, disclose confidential information, abandon the business, transfer control without approval, fail to maintain Designated Manager supervision for 180 days after death/incapacity, understate amounts due by more than 3% on two or more occasions, are adjudicated bankrupt, misuse Marks, fail to submit reports/pay fees on two or more occasions, violate health/safety laws, engage in unauthorized alcohol sales, engage in exclusively reserved franchisor activity, fail to comply with law after notice, repeatedly breach the Agreement, default under other agreements, fail to obtain financing within 60 days, or fail to select an approved site within 120 days. For other defaults (e.g., failure to pay amounts due, non-compliance with specifications), you may have 5 or 30 days to cure after notice.
Non-Compete Period3 years
Non-Compete DetailsDuring the term of the Agreement and for three (3) years after its expiration or termination, neither you, your owners, nor certain employees may directly or indirectly own an interest in, manage, operate, or provide services to any Competitive Business within a thirty (30) mile radius of your Approved Location or any other MONSTER MINI GOLF™ Business. You are also prohibited from soliciting customers or employees of the franchisor or other franchisees during this period. The franchisor reserves the right to reduce the scope of this covenant without your consent.

Participation DetailsThe Franchised Business must always be under the direct full-time supervision of a Designated Manager. If you are an individual, you are the Designated Manager. If you are a business entity, you select an individual to be the Designated Manager. The Designated Manager must attend and satisfactorily complete our initial training program before opening. Anyone owning a 20% or greater interest in a business entity franchisee must personally guarantee all obligations under the Franchise Agreement.
Required SuppliersMany products, supplies, and services, including point-of-sale system and software, certain advertising and marketing items, branded retail merchandise, certain redemption items, certain arcade, bowling and amusement equipment, and laser tag software, vests, guns and supplies may only be purchased from Approved Suppliers. Our Affiliate, Twisted Toybox, is currently the only Approved Supplier of the Phase II Build-Out Package (including sound, lighting and effects package, golf course materials, construction materials and services, and props) and the Laser Tag Arena Theming Package.
Supply RestrictionsFranchisees must purchase goods and services from us, our Affiliate, or Approved Suppliers, or in accordance with our standards and specifications. If a franchisee wishes to use an unapproved item, service, or supplier, they must submit sufficient information for franchisor approval, which may be denied in our sole discretion. We reserve the right to designate ourselves or our affiliates as the only Approved Supplier for certain products and services. We may revoke approval of any item, service, or supplier at any time.
Franchisor Revenue from SuppliersIn the year ending December 31, 2021, our affiliate Twisted Toybox received $219,107.00 of its total revenue from required purchases or leases by our franchisees. We and our affiliates may derive revenue and other material benefits, including rebates (approximately 0.5% to 22% of total purchases) from some suppliers based on franchisee purchases, and we have no obligation to pass these on to franchisees.
